Terms of service

This is the most important thing on the page, so it is first.

In an emergency, call 000. Orbities does not contact emergency services on your behalf, is not monitored by anybody, and cannot dispatch help. SOS alerts the people in your circle — that is all it does, and it is all it claims to do.

Orbities depends on things outside our control: a charged phone, a mobile network, GPS reception, and an operating system that has not stopped the app to save battery. Any of those can fail. This is why the product tells you how old a position is and how confident it was, instead of showing a dot and letting you assume. Do not build a safety plan that fails when the app does.

You must be 18 or older to create a circle and agree to these terms. A person under 18 can be a member of a circle set up by a parent or guardian, who agrees to these terms on their behalf.

Adding somebody to a circle means telling them. Using Orbities to track an adult without their knowledge is a misuse of it, and the product is built to make it difficult: every member can see what is shared about them, who has looked, and when. We will close accounts used to conceal tracking from the person tracked.

You are responsible for keeping your sign-in details to yourself. If you think somebody else has your account, end their session from Sessions & devices and change your password — both work without contacting us.

A member of a family who has no email address of their own can be set up with a device code instead. That handset is signed in as them, and the person who created the code can revoke it at any time.

Where a subscription is bought through the App Store or Google Play, their billing and refund rules apply and cancellation happens in that store.

Use Orbities to:

• track any adult who has not agreed to it;
• get around a court order, or contact somebody who has asked you not to;
• break into anybody's account, or attempt to;
• resell access, or run it as a service for people outside your family;
• interfere with the service, or with other people's use of it.

If you find a security flaw, tell us at [email protected] and give us a reasonable chance to fix it. We will not pursue anybody who reports a problem in good faith and does not exploit it.

Your data is yours. We do not sell it and we do not use it to advertise to you. What we collect, how long we keep it and how to take it or delete it is set out in the privacy policy, which forms part of these terms.

We aim to keep Orbities running continuously but do not guarantee it. Planned maintenance is announced in the app. Unplanned outages are shown on the status page, and within the app the support screen says directly whether a stale location is our fault or the phone's.

Features change. If we remove one you rely on, or change what we collect, we will tell you in the app before it happens rather than only editing a page.

You can close your account at any time from Privacy → your account. Closing it deletes your data on the terms set out in the privacy policy.

We may suspend or close an account that breaks these terms. Where we can, we will tell you why and give you a chance to put it right first — unless doing so would put somebody at risk, which is the case that overrides it.

Nothing in these terms excludes any guarantee, right or remedy under the Australian Consumer Law. Where the law allows us to limit liability, our liability for a failure of the service is limited to resupplying it or paying the cost of doing so.

We are not liable for a loss caused by something the product cannot control — a flat battery, a network outage, an operating system stopping the app, or a position that was accurate when it was taken and out of date by the time it was read. Saying so is not a disclaimer we hide behind: it is why the product shows you the age and accuracy of every position rather than letting you assume.

These terms are governed by the laws of Queensland, Australia. If a clause is unenforceable, the rest stands.
